But you have to form, and maintain a Delaware corporation, and in Georgia, you also have to make sure that the "Deleware airplane" is not located in the state on Jan 1st (the date of taxation in Georgia), and can prove it.

Some boat owners do the same thing, registering their craft in Rhode Island or Delaware. So the Connecticut legislature changed the law to say that if the boat spends at least 60 days in CT waters, you have to register it here. Furthermore, the marinas are required to notify the state of such time-in-residence. In effect, all of the marinas have been deputized as unpaid tax enforcers.

Which is not unusual, since payroll managers are effectively unpaid federal/state tax collectors of payroll taxes on their employees. <img src="/ubbthreads/images/graemlins/frown.gif" alt="" />

As someone opined earlier on this board - sure, you may think you own your airplane outright, but miss a few tax payments and watch how fast it gets taken away!

a lot of owners think the Delaware corporation is a good idea. I believe it is tenuous at best. Trying to dodge a tax is great if you get away with it, but expensive if the state/court doesn't agree.

It is illegal to EVADE taxes, Legal to avoid taxes. Call the tax department and get the real story!

Seems the problems with state sales tax in NJ is somewhat contagious. I have received a letter from The State of Connecticut Department of Revenue Services questioning my payment of sales tax 1 1/2 years ago, when I bought my airplane. At first I though this was an isolated audit, but I have spoken to many other pilots at my airport and they all seemed to have gotten the same letter. A lot of these folks have owned their airplanes for quite a number of years and they are all hoping they can produce records showing their payment.

This has created quite a stir at our airport with some people threatening to call the State Attorney General for an investigation into where their funds went and how there are no records of this many transactions.

Kirk, or anyone else in CT, I'd be interested in knowing if you have gotten one of these intimidating letters. Have to wonder just how wide spread this is and how much it cost the taxpayers to do a records check on something they should already have records of.

We have an interesting Gov't situation here in NJ. The government is shut down basically due to a budget stalemate.
They've closed the casino floors and State Parks.
The issue is sales tax on Accountants and Lawyers vs increased income tax for all.

I guess that I'm just lucky. Mississippi levies a 3% sales tax on aircraft imported to the state if purchased from a dealer. All that I had to have was a bill of sale showing that "Royson Parsons" was not a dealership and the tax was waived. Ya know, that Parsons guy just might be a wheeler/dealer in disguise. LOL. Now the only "fee" is a $25.00 yearly registration fee. What a deal!
